Welcome to Neatwell. These Terms of Service (“Terms”) are the rules for using neatwell.shop (the “Website”) and buying from Neatwell. By visiting the Website, creating an account or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.

About Neatwell

Neatwell (“Neatwell”, “we”, “us” or “our”) is a home organization brand that sells drawer organizers, closet organizers and under-bed storage to customers in the United States.

Who Can Use the Website

You must be at least 18 years old, or the age of majority where you live, to place an order. By placing an order, you confirm that you can legally enter into a binding agreement and that the information you provide is true, accurate and complete.

Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top shows when they were last changed. Changes apply from the date they are posted and do not affect orders you placed before that date. If you keep using the Website after changes are posted, you accept the updated Terms.

Your Account

You do not need an account to place an order. If you create one, you are responsible for keeping your login details private and for all activity under your account. Please tell us right away at inquiries@neatwell.shop if you think someone has used your account without permission. We may suspend or close accounts that are used for fraud, abuse or breaking these Terms.

Products and Descriptions

We work hard to describe our products accurately, including sizes, materials, colors, weight limits and what is included. Please keep the following in mind:

  • Measurements and weights are approximate and may vary slightly.
  • Colors may look slightly different on different screens.
  • Please measure your drawer, shelf, closet or the space under your bed before ordering. Each product page lists the size you need.
  • Items, blankets, clothes or other things shown inside or next to a product in photos are for display only. Only the product listed under “Package Includes” is sent.
  • Product information is provided to help you choose. It is not professional, structural or safety advice.

Pricing and Availability

All prices are in U.S. dollars (USD). Shipping is free on every order within the United States. Any applicable taxes are calculated and shown at checkout before you place your order. Prices, products and availability can change at any time without notice.

If a product is listed at the wrong price because of an obvious error, or is out of stock, we may contact you to confirm the correct price or cancel the order before it ships. You will never be charged a different amount at delivery without being told first.

Orders and Acceptance

When you place an order, you are making an offer to buy. You will receive an order confirmation email, but this is not our final acceptance. We accept your order when we ship it.

Because payment is collected on delivery, we may email or call you to confirm your name, phone number and address before shipping. We may hold, refuse or cancel an order, for example if:

  • We cannot reach you or confirm your details
  • The product is out of stock or listed with an error
  • The address or other information looks incorrect or incomplete
  • We suspect fraud, a fake order or misuse of the Website
  • You have had repeated refused or undelivered orders in the past

If we cancel an order, we will let you know. No payment is collected for cancelled orders.

Payment

We currently accept Cash on Delivery (COD) only. You pay the order total in cash when your package is delivered. There is no COD fee or handling fee. By choosing COD, you agree to be available at the delivery address, to have the exact order total ready, and to pay when the package arrives. Please read our Payment Policy for details.

Shipping and Delivery

We ship to addresses within the United States. Delivery to PO Boxes and military addresses (APO/FPO) may not be available.

  • Processing time: 1-2 business days. Orders placed before 5:00 PM CT on a business day begin processing that day. Orders placed after 5:00 PM CT, on weekends or on U.S. holidays begin processing on the next business day.
  • Delivery time: 4-6 business days after shipping.
  • Total estimated delivery: 5-8 business days from the date you place your order.
  • Carrier: our Trusted Delivery Partners.
  • Tracking: every order includes a tracking number, emailed to you when your order ships. You can follow it on our Track Your Order page.

Delivery dates are estimates, not guarantees. Weather, carrier delays, holidays, incorrect addresses and other events outside our control can add time. Risk of loss passes to you when the package is delivered and paid for. Please read our Shipping Policy for full details.

Returns, Refunds and Cancellations

Our Return & Refund Policy is part of these Terms. In short:

  • You can return most items within 30 days of delivery if they are unused, in original condition and in original packaging with all parts.
  • Return shipping is free. We email you a prepaid return label after you contact us.
  • Refunds are issued by bank transfer or store credit, whichever you prefer, and are processed within 7 days after we receive and approve your return.
  • You can cancel within 24 hours of placing an order, as long as it has not shipped.
  • Damaged, defective or wrong items must be reported within 30 days of delivery with photos. We will replace or refund them at no cost to you.

If these Terms and the Return & Refund Policy ever differ on returns, the Return & Refund Policy applies.

Proper Use and Safety

Our products are designed for household use with lightweight to medium items such as clothes, blankets, linens, utensils and everyday supplies. Please follow these rules:

  • Use products only as described on the product page.
  • Do not exceed the recommended weight limit listed on the product page.
  • Do not use hanging, stacking or tension-fit products to hold very heavy items, or to support the weight of people or pets.
  • Keep small parts, fabric straps and plastic windows away from young children and pets.
  • Do not use products near open flames or high heat.
  • Clean and care for products as described on the product page.

We are not responsible for damage or injury caused by misuse, overloading, incorrect installation or not following these instructions.

Intellectual Property

All content on the Website, including the Neatwell name, logo, text, product descriptions, images, graphics, layout and design, belongs to Neatwell or is used with permission, and is protected by copyright, trademark and other laws. You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce, modify, distribute, resell or use our content for commercial purposes, or use the Neatwell name or logo, without our written permission.

Messages and Content You Send Us

If you send us messages, photos, reviews or other content (for example, photos of a damaged item), you confirm that you have the right to share it. You give us permission to use it to answer your request, handle your order, return or refund, improve our products and service, and, for reviews you choose to post, display it on our Website. We will not publish your photos of an item or your personal details without your permission, other than a review you submit for display.

Prohibited Use

You agree not to:

  • Place fake, fraudulent or prank orders, or give false names, phone numbers or addresses
  • Repeatedly refuse or fail to accept Cash on Delivery orders
  • Use the Website for any unlawful purpose
  • Try to break, probe or interfere with the security or operation of the Website
  • Use bots, scrapers or automated tools to collect content or place orders, unless we give written permission
  • Copy or resell our content, product photos or descriptions
  • Send viruses, harmful code or spam
  • Harass or abuse our team or other customers

We may block access, cancel orders or close accounts for any of the above, and may report unlawful activity to the authorities.

Communications

By placing an order, you agree that we may contact you by email, phone or text message about your order, delivery, returns and support. These are service messages. We send marketing emails only if you subscribe, and each one has an unsubscribe link. We do not send marketing text messages at this time. See our Privacy Policy for details.

Privacy

Our Privacy Policy explains how we collect, use and protect your personal information, and describes your privacy rights. It is part of these Terms.

Third-Party Links and Services

The Website may link to other sites and services, such as our YouTube channel, our Pinterest page and our order tracking page. We do not control those sites or services and are not responsible for their content, availability or privacy practices. Using them is at your own risk and under their own terms.

Disclaimer of Warranties

The Website and our products are provided “as is” and “as available”. To the fullest extent permitted by law, we do not make any promises, express or implied, about the Website being uninterrupted, secure or error-free, or that product descriptions, photos or other content are completely accurate or current. Except as stated in these Terms and our Return & Refund Policy, we do not give a separate written warranty on our products, and, to the extent the law allows, we disclaim implied warranties such as merchantability and fitness for a particular purpose. Some states do not allow these exclusions, so they may not apply to you. Nothing in these Terms takes away rights you have under applicable consumer protection laws.

Limitation of Liability

To the fullest extent permitted by law, Neatwell, its owners and team members are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or loss of use, arising from your use of the Website or products, even if we were told such damage was possible. Our total liability for any claim related to an order will not exceed the amount you paid for the product involved. Some states do not allow limits on certain damages, so these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

Indemnification

You agree to protect and hold Neatwell harmless from claims, losses and reasonable costs (including reasonable legal fees) that come from your misuse of the Website or products, your breach of these Terms, or your violation of any law or the rights of another person.

Events Outside Our Control

We are not responsible for delays or failure to perform caused by events outside our reasonable control, including severe weather, natural disasters, carrier or supplier disruptions, public health emergencies, labor disputes, power or internet outages and government actions. If this affects your order, we will let you know and work with you on a solution, which may include a refund or cancellation.

Resolving Disputes

If you have a problem with an order or these Terms, please contact us first at inquiries@neatwell.shop. We reply within 24 hours on business days, and most issues can be solved directly. If we cannot resolve it, you agree to give us at least 30 days to try before starting any formal legal claim, unless the law gives you a different right.

Governing Law and Venue

These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-law rules. Any legal action related to these Terms or your orders will be brought in the state or federal courts located in Shelby County, Tennessee, and you agree to those courts’ authority, except where applicable law gives you the right to bring a claim in the courts of your home state. You may also report unfair or deceptive practices to your state attorney general or to the U.S. Federal Trade Commission at ReportFraud.ftc.gov.

General Terms

  • Entire agreement: these Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy and Payment Policy, are the entire agreement between you and Neatwell about the Website and your orders.
  • Severability: if any part of these Terms is found unenforceable, the rest stays in effect.
  • No waiver: if we do not enforce a right right away, it does not mean we give it up.
  • Assignment: you may not transfer your rights under these Terms without our written permission. We may transfer ours in connection with a sale, merger or reorganization of our business.
  • Headings: headings are for convenience only and do not change the meaning of these Terms.
  • Electronic communications: you agree that notices we send by email or post on the Website satisfy any legal requirement to give notice in writing.
